What is BMP?
In short, Infuse bone grafts rely on a liquid protein that is used to grow artificial bone. This protein is known as bone morphogenetic protein (BMP), and it is placed between the vertebrae (bones in the spine) to replace damaged discs and bridge the gap between damaged spinal bones.
Medtronic Infuse has been approved by the FDA for use in very specific surgeries: to treat degenerative disc disease, in open tibia fractures, and in two dental bone grafting surgeries. However, Infuse has also been used “off-label” in cervical, or neck surgery. It is not approved for this use, and serious injuries can result when Infuse is used in a cervical fusion surgery. Infused is also often used off-label in lumbar fusions where there is a posterior or lateral approach to the procedure (not through abdomen).
BMP Side Effects and Complications
Off-label use of Medtronic Infuse Bone Graft may lead to serious side effects that cause significant pain and may result in further surgeries or the death of the patient. Some of the most common BMP side effects include:
- Ectopic or uncontrolled bone growth
- Neck swelling
- Formation of inflammatory cysts
- Airway compression
- Swallowing difficulties`
- Speech problems
- Respiratory difficulties
- Damage to nerves
- Male sterility
- Retrograde ejaculation
FDA Warning about Medtronic Infuse BMP
On July 1, 2008 the FDA issued a Medtronic Infuse Bone Graft warning. This statement urged physicians not to use this product for off-label cervical surgeries. The FDA warns cervical surgery with Infuse can cause potentially deadly complications, stating “the safety and effectiveness of rhBMP in the cervical spine have not been demonstrated and these products are not approved by the FDA for this use.”
In this Medtronic Infuse safety warning, the FDA reveals that they have received no less than 38 reports of Medtronic Infuse BMP complications over the last 4 years. All of these reports were in reference to off-label use of Infuse, and all of the injuries were a result of neck and throat swelling that could have deadly consequences.
Medtronic Infuse BMP Bone Graft Lawsuits
Victims of Infuse BMP Bone Graft may be able to file a medical product liability lawsuit against the maker of this device, Medtronic. The Medtronic Infuse Bone Graft lawyers at our firm allege:
- It is illegal to advertise medical devices for off-label uses. We have strong evidence that Medtronic promoted Infuse for cervical surgery and other off-label uses.
- A surgeon on the Medtronic payroll (for $800,000) published false study results detailing off-label use of Infuse.
- Medtronic willfully downplayed any risks of injury or death associated with Infuse
- Hundreds of patients were not informed that their surgeries involved off-label use of Medtronic Infuse. As such, they were not made aware of the potential dangers associated with their procedures.
